1. Acceptance of Terms

3. User Accounts and Registration

To access certain features of our Services, you may be required to create an account. You agree to:

• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You may not use another person's account or share your account credentials. We reserve the right to terminate accounts that provide false or misleading information.

4. Service Appointments and Estimates

Appointments made through our Site or by phone are subject to confirmation. Service estimates provided are approximations based on preliminary assessment and may change upon detailed inspection. Final charges will be based on actual work performed and parts used. We will obtain your approval before performing work that exceeds the original estimate by more than 10% or $100, whichever is less.

Cancellations must be made at least 24 hours in advance. Late cancellations or no-shows may be subject to a cancellation fee.

5. Payment Terms

Payment is due upon completion of services unless other arrangements have been made in advance. We accept cash, credit cards, and debit cards. A service charge may apply to returned checks. Unpaid balances may be subject to interest charges at the maximum rate permitted by law. You are responsible for all costs of collection, including reasonable attorney fees, for any unpaid amounts.

6. Warranty and Service Guarantees

We warrant our workmanship for a period of 90 days or 3,000 miles, whichever comes first, from the date of service. Parts are covered by the manufacturer's warranty. This warranty does not cover:

• Damage caused by accidents, misuse, or neglect
• Normal wear and tear
• Failures caused by lack of maintenance
• Modifications made after our service
• Acts of nature or environmental factors

Our warranty is limited to repair or replacement of defective workmanship. We are not liable for consequential damages, towing charges, rental car costs, or lost wages.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TORQUE AUTO WORKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising from or related to the Services shall not exceed the amount you paid us in the twelve (12) months prior to the claim, or $500, whichever is greater.

8. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Torque Auto Works operates, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within the county of our principal place of business for the resolution of any disputes.

16. Dispute Resolution

Informal Resolution: Before filing a claim, you agree to contact us and attempt to resolve the dispute informally by sending written notice to our address. We will attempt to resolve the dispute through good faith negotiation.

Arbitration Agreement: If we cannot resolve the dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the county of our principal place of business. Judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired. The invalid provision shall be replaced with a valid provision that most closely matches the intent of the original provision.

18. Entire Agreement
